For the purposes of these Terms & Conditions, the following definitions apply throughout this document:

By accessing the 38phcash platform, registering an account, making a deposit, placing a wager, or using any feature of the platform, you confirm that you have read, understood, and unconditionally agreed to be bound by these Terms & Conditions in their entirety, including any documents incorporated herein by reference, such as the Privacy Policy and the Responsible Gaming Policy.

If you do not agree with any part of these Terms & Conditions, you must immediately cease using the 38phcash platform and, if applicable, request the closure of your account by contacting customer support.

These Terms & Conditions constitute a legally binding agreement between you and 38phcash. 3.1 Age Requirement. The 38phcash platform is strictly available to individuals who are at least twenty-one (21) years of age at the time of registration and at all times during their use of the platform. Any account found to have been opened by a person under 21 years of age will be immediately suspended, all associated balances will be frozen pending investigation, and any winnings accrued during the period of underage access will be forfeited.

3.2 Jurisdictional Eligibility. The 38phcash platform is designed and licensed to serve players located in the Philippines. Players accessing the platform from jurisdictions where online gambling is prohibited by local law do so at their own legal risk. 38phcash accepts no liability for legal consequences arising from access in restricted jurisdictions.

3.3 One Account Per Person. Each natural person is permitted to register and maintain exactly one (1) 38phcash account. The creation of duplicate accounts — including accounts in a different name, using a different mobile number, or using a different email address — is a material breach of these Terms. 38phcash reserves the right to suspend all accounts associated with a person found to have registered multiple accounts and to forfeit all balances therein.

3.4 Registration Information. When registering on 38phcash, you are required to provide accurate, current, and complete information including your legal full name, date of birth, valid Philippine mobile number, and email address. You must update your account information promptly if any of these details change. 38phcash is not liable for any service disruption caused by incorrect account information provided at registration.

3.5 KYC Identity Verification. Prior to processing your first withdrawal, 38phcash is required under PAGCOR's anti-money laundering compliance framework to verify your identity. You will be required to submit a clear photograph of a valid Philippine government-issued identification document. Accepted documents include the Philippine National ID (PhilSys), Social Security System (SSS) card, Unified Multi-Purpose ID (UMID), Land Transportation Office driver's license, and Philippine passport. Failure to complete KYC verification will result in the inability to withdraw funds; the account may continue to be used for deposit and wagering purposes in the interim.

4.1 Player Responsibility. You are solely responsible for maintaining the confidentiality of your 38phcash account login credentials, including your username, password, and any two-factor authentication codes associated with your account. You must not share your credentials with any third party.

4.2 Unauthorized Access. You must notify 38phcash immediately upon becoming aware of any unauthorized access to or use of your account. If you must access your account from such a device, ensure you log out completely upon concluding your session and do not enable any session persistence features.

5.1 Accepted Payment Methods. 38phcash currently accepts deposits via the following Philippine payment channels: GCash, PayMaya (Maya), BPI Online, BDO Online, Metrobank Online, InstaPay, and PESONet. All account balances are denominated in Philippine Peso (PHP). 38phcash does not accept deposits in foreign currencies, and no currency conversion is applied to PHP deposits.

5.2 Minimum Deposit. The minimum deposit amount is PHP 50 for GCash and PayMaya transactions and PHP 200 for bank transfer transactions. 38phcash does not charge a deposit fee on standard transactions; however, third-party processing fees imposed by your payment provider are the responsibility of the depositing player.

5.3 Deposit Crediting. GCash and PayMaya deposits are typically credited to your 38phcash account within two (2) minutes of successful payment confirmation. Bank transfers via InstaPay are typically credited within five (5) to thirty (30) minutes depending on the sending institution's processing time. PESONet transfers follow Philippine central bank clearing schedules. 38phcash is not responsible for delays attributable to third-party payment infrastructure.

5.4 Source of Funds. By making a deposit on 38phcash, you confirm that the funds deposited are from a legitimate source, that you are the authorized owner or user of the payment method used, and that the deposit does not violate any applicable Philippine law or regulation. 38phcash is required to report suspicious financial activity to relevant Philippine regulatory authorities.

5.5 Deposit Limit Tools. Players may set daily, weekly, or monthly deposit limits from the Responsible Gaming section of their account settings. Limit reductions take effect immediately. Limit increases are subject to a twenty-four (24) hour review period before taking effect, in compliance with responsible gaming standards.

6.1 Withdrawal Eligibility. Withdrawal of funds from a 38phcash account requires the completion of KYC identity verification as described in Section 3.5. No exceptions to this requirement will be granted regardless of the withdrawal amount or account history.

6.2 Withdrawal Methods. 38phcash processes withdrawals to the same payment method used for the most recent deposit or to a verified payment method registered in the player's account. Withdrawals are processed to GCash, PayMaya, BPI, BDO, and Metrobank accounts held in the same name as the verified 38phcash account. Withdrawals to third-party accounts are not permitted.

6.3 Processing Time. 38phcash operates its cashier function 24 hours a day, 7 days a week. GCash and PayMaya withdrawal requests are processed with an average completion time of under fifteen (15) minutes from request submission. Bank transfer withdrawals are processed same-day during standard Philippine banking hours. Processing times may be extended during periods of high volume or for accounts subject to enhanced due diligence review.

6.4 Withdrawal of Bonus Winnings. Winnings derived from Bonus Balance are not available for withdrawal until all applicable wagering requirements have been satisfied. Winnings from Bonus Balance that exceed the specified maximum bonus withdrawal cap (as communicated in the applicable bonus terms) will be forfeited at the time of withdrawal processing.

6.5 Withholding of Withdrawals. 38phcash reserves the right to delay or withhold withdrawal processing in circumstances including but not limited to: incomplete or pending KYC verification, active fraud or collusion investigation, suspected money laundering activity, account balance dispute, or at the direction of PAGCOR or any competent Philippine authority. In such cases, 38phcash will notify the player and provide a reasonable timeline for resolution where permissible by law.

7.1 General Bonus Terms. All bonuses, free credits, reload offers, cashback promotions, and VIP rewards issued by 38phcash are subject to the specific terms communicated at the time each offer is made, in addition to these General Terms & Conditions. In the event of a conflict between offer-specific terms and these General Terms, the offer-specific terms shall prevail with respect to that particular promotion.

7.2 Wagering Requirements. Unless otherwise specified, all bonus credits issued by 38phcash are subject to a wagering requirement that must be satisfied before the bonus funds or any winnings derived therefrom may be withdrawn. The applicable wagering multiplier and eligible contributing game categories will be communicated with each offer. Bets placed on games excluded from bonus wagering contribution will not count toward the requirement.

7.3 Bonus Expiry. All bonus credits are subject to an expiry period commencing from the date of issuance. Bonus funds and any associated wagering requirements that remain unsatisfied at the expiry date will be automatically removed from the player's account without further notice.

7.4 One Bonus at a Time. Players may not hold more than one active bonus promotion simultaneously unless the specific promotion terms expressly permit combination with another offer. Attempting to claim multiple concurrent bonuses in violation of this rule may result in forfeiture of all active bonus balances.

7.5 Anti-Abuse. 38phcash employs automated and manual systems to detect bonus abuse, including but not limited to: use of multiple accounts to claim the same offer, coordinated wagering patterns designed to meet wagering requirements with minimal risk, and use of low-margin or excluded games to complete requirements. Where bonus abuse is confirmed, 38phcash reserves the right to void the bonus and any resulting winnings.

8.1 Certified RNG. All random-outcome games available on the 38phcash platform — including slot games, RNG baccarat, RNG roulette, and bingo — use Random Number Generators that have been tested and certified by accredited independent testing laboratories. Certifications confirm that game outcomes are statistically random and not influenced by any external factor, including prior game history or player betting patterns.

8.2 Published Return to Player Rates. 38phcash publishes certified Return to Player (RTP) percentages for all game titles in the platform library. RTP values represent the theoretical long-run average percentage of wagered amounts returned to players across a statistically significant number of game rounds. Individual session outcomes may differ substantially from the theoretical RTP.

8.3 Game Malfunctions. In the event of a technical error, communication failure, or game malfunction during any game session, the affected game round will be voided and any wager placed during the affected round will be returned to the player's real money balance. 38phcash does not honor game outcomes or payout claims arising from confirmed malfunctions. The determination of whether a malfunction has occurred rests solely with 38phcash's technical operations team, subject to PAGCOR oversight.

8.4 Intellectual Property of Games. All games available on the 38phcash platform are licensed from third-party game providers including but not limited to Jili Games, PG Soft, and Pragmatic Play. The rules, mechanics, and paytables of these games are governed by the respective providers' certified game mathematics. 38phcash makes no modifications to provider game logic.

Players are strictly prohibited from engaging in the following conduct on the 38phcash platform. Violation of any prohibition may result in immediate account suspension, forfeiture of balances, and referral to PAGCOR or relevant Philippine law enforcement authorities:

• Fraudulent activity — including use of stolen, fraudulent, or unauthorized payment methods; chargebacks; or misrepresentation of identity during KYC verification.
• Money laundering — using the 38phcash platform to deposit, wager, and withdraw funds for the purpose of concealing the origin of illegally obtained money.
• Collusion — coordinating with other players in live dealer games or tournament environments to gain an unfair advantage, including chip-dumping or seat-reservation schemes.

10.1 Platform Commitment. 38phcash is committed to providing a safe gambling environment. 10.2 Self-Exclusion. A player who submits a self-exclusion request will have their account access suspended immediately upon processing. 11.2 Limited License to Players. 38phcash grants you a personal, non-exclusive, non-transferable, revocable license to access and use the platform for your personal, non-commercial gambling activities in accordance with these Terms & Conditions. 11.3 Prohibited Uses. Scheduled and unscheduled maintenance, third-party service failures, and events beyond our reasonable control may result in temporary unavailability. 38phcash will not be liable for any loss arising from platform downtime that is outside our reasonable operational control.

12.3 Maximum Liability. To the maximum extent permitted by applicable Philippine law, 38phcash's total aggregate liability to any player arising out of or in connection with their use of the platform shall not exceed the amount of the player's real money balance at the time the claim arises, or PHP 10,000, whichever is lower, except in cases of fraud or willful misconduct by 38phcash.

12.4 Third-Party Services. 38phcash is not liable for the performance, availability, or security of third-party services including GCash, PayMaya, BPI, BDO, Metrobank, game providers, or any other external service integrated into the platform. Any disputes involving third-party services must be resolved directly with those providers.

13.1 Suspension by 38phcash. 38phcash reserves the right to suspend or terminate any player account at any time, with or without prior notice, for any of the following reasons: breach of these Terms & Conditions; suspected fraud, money laundering, or collusion; PAGCOR directive or court order; failure to complete KYC verification within a reasonable period; or any other circumstance that, in 38phcash's reasonable judgment, poses a risk to the platform, other players, or regulatory compliance.

13.2 Effect of Suspension. Upon suspension or termination of an account, 38phcash will conduct a review of the account activity. Real money balances will be frozen during the review period. Where no breach of these Terms is established, frozen balances will be returned to the player via the verified payment method on record. Where a breach is established, balances may be forfeited in whole or in part depending on the nature and extent of the breach.

13.3 Voluntary Account Closure. Players who wish to close their 38phcash account voluntarily must submit a closure request to customer support. Any remaining real money balance will be returned to the player's verified withdrawal method following final account reconciliation. Bonus balances are forfeited upon voluntary account closure.

14.1 Internal Complaints Process. In the event of a conflict between a player's recollection of a game outcome and 38phcash's server logs, the server logs shall be conclusive unless a technical malfunction is confirmed by the game provider's audit team.

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of the Philippines, including but not limited to the Presidential Decree No. 1869 (PAGCOR Charter) as amended, the Anti-Money Laundering Act of 2001 (Republic Act No. 9160) as amended, and the Data Privacy Act of 2012 (Republic Act No. 10173).

Any legal action or proceeding arising out of or in connection with these Terms & Conditions that cannot be resolved through the dispute resolution process in Section 14 shall be subject to the exclusive jurisdiction of the competent courts of the Philippines.

38phcash reserves the right to amend, modify, or replace these Terms & Conditions at any time. Where amendments are material — meaning they substantially affect player rights or obligations — 38phcash will provide advance notice via the platform notification system, email to registered player addresses, or both, no less than seven (7) days prior to the effective date of the amendment.

Non-material amendments, such as typographical corrections, clarifications that do not alter the substance of any provision, or changes required by applicable law, may take effect immediately upon publication without advance notice.

Players who continue to use the platform after the effective date of any amendment are deemed to have accepted the revised Terms. Players who do not accept a material amendment should close their account prior to the amendment's effective date.
